Release of Liability *PLEASE READ CAREFULLY BEFORE PARTICIPATING IN THE 5K RUN EVENT. ACTIVITIES AND ASSOCIATED RISKS, RELEASE OF LIABILITY, INDEMNIFICATION, GENERAL PROVISIONS AND ASSUMPTION OF RISK AGREEMENT: Participant(s) attending this event have chosen to participate in the Brindavana 5K Run Activities understand the following: ACTIVITIES AND ASSOCIATED RISKS: 5K Run Event: Participant(s) understands that they will be participating in a 5K run event organized by Brindavana (Event Organizer). This event may include running or walking a distance of approximately 5 kilometers, on designated routes, through various terrains and environments. Inherent Risks: Participant(s) acknowledges that participating in the 5K run event carries inherent risks and dangers, which may include, but are not limited to, the risk of injury, illness, or death due to accidents, falls, collisions, overexertion, weather conditions, inadequate safety measures, or unforeseen hazards. Assumption of Risk: Participant voluntarily assumes all risks and hazards associated with participating in the 5K run event. Participant(s) acknowledges that these risks may be both foreseeable and unforeseeable, and Participant chooses to participate in this event despite these risks. RELEASE OF LIABILITY: Waiver of Claims: Participant(s), on behalf of themselves and their heirs, assigns, and next of kin, hereby releases and discharges Event Organizer from any and all liability, claims, actions, demands, expenses, or damages arising from or in any way connected with Participant's participation in the 5K run event. No Liability for Negligence: Participant acknowledges that this release includes any claims based on the negligence of Event Organizer, whether that negligence is in the organization, conduct, supervision, or management of the 5K run event. INDEMNIFICATION: Indemnification: Participant(s) agrees to indemnify, defend, and hold harmless Event Organizer, its officers, directors and agents, from any and all claims, actions, demands, expenses, or damages, including attorney's fees, resulting from Participant's participation in the 5K run event. GENERAL PROVISIONS: Medical Fitness: Participant(s) represents that they are in good physical condition and have no medical or health conditions that would prevent them from safely participating in the 5K run event. Participant(s) agrees to abide by any rules or instructions provided by Event Organizer during the event. Use of Likeness: Participant(s) grants Event Organizer the right to use their name, photograph, and likeness in connection with any promotional materials or advertising for the 5K run event. Entire Agreement: This Agreement contains the entire agreement between the parties and supersedes all prior and contemporaneous agreements, understandings, and representations, whether oral or written. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of NJ State . I/We, the undersigned Participant(s), have carefully read and understand this Agreement. I/We acknowledge that I/We am/are voluntarily participating in the 5K run event and hereby agree to be bound by the terms and conditions outlined herein.
